Terms of service

Draft, awaiting legal review. This text describes how KeyVanguard works today and will be finalised before we take payment.

Who we are

KeyVanguard (“we”, “us”) is an independent buyer's service for new cars, headquartered in Virginia. These terms apply when you use this site or ask us to search and negotiate a car for you (“you”). By submitting an intake and paying the fee, you agree to them.

What the service is

For a flat fee, we carry out one search and negotiation for one new vehicle that you describe in your intake. We research the market, contact dealers that have matching cars, negotiate with them on your behalf without disclosing your identity, and send you a report of the negotiated deals we obtained. We aim for at least five.

Our service ends when we send your report.

What the service is not

• We handle new vehicles only.
• We do not buy, sell or lease vehicles, and we are not a dealer. We never take possession of a vehicle or of any money paid for one.
• We do not sign anything on your behalf, and we do not arrange financing, insurance or registration.
• Any purchase is a contract between you and the dealer you choose, made in your own name. You should read that contract yourself before signing.

The fee

The fee is $399 per vehicle search, paid in advance when you submit your intake. It is the only money we receive for your search. We accept no payment, referral fee or commission from any dealer or manufacturer.

Turnaround

Most searches finish within one to two weeks of your submitted intake and payment. This is an estimate, not a deadline: dealers reply on their own schedule.

No guaranteed price or saving

We negotiate on a best-effort basis. We do not guarantee any particular price, saving, number of offers or availability of any vehicle. Offers in your report are made by the dealers, not by us; a dealer may change or withdraw an offer, and inventory can sell before you act. You are never obliged to buy.

Refunds and changes

• Once work on your search has started, the fee is not refundable.
• Once a search has started, changing the vehicle or your criteria requires a new search, which carries an additional fee.

Your part

Please give us accurate information in your intake. Our results depend on it, and we are not responsible for a search that goes wrong because the details were inaccurate.

Your report

Your report is for your own use in buying the vehicle. Please don't publish it or pass it to anyone other than the dealer you choose.

Your account

You sign in with a link sent to your email address, so keep access to that inbox secure. You are responsible for activity on your account.

Liability

To the extent the law allows, our total liability to you for any claim connected with a search is limited to the fee you paid for that search. We are not responsible for the acts of any dealer, or for the condition, delivery or financing of any vehicle.

Changes to these terms

We may update these terms. The version in force when you paid for a search applies to that search.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia.
